Partner Jay Eigerman leads the firm’s Zoning & Land Use practice. Together with his partners Phil Graeter and Karen Kepler, Mr. Eigerman represents residential, commercial and institutional real estate developers to secure all necessary government approvals at the federal, state and local levels. Trained as a city planner and a lawyer, his expertise includes conducting zoning and permitting due diligence, devising and implementing permitting strategies, and writing zoning and permitting opinions for financing.
Representative projects include:
- Replacement of an historic former warehouse in Boston’s Fort Point Channel neighborhood with a new 20-story building, with approximately 184 rental apartments and a 96-space parking garage, including environmental impact review, rezoning, and historic preservation and state highway access approvals.
- Rehabilitation and deep energy retrofit of a complex of approximately 500 affordable housing units in Boston’s South End neighborhood, including land disposition agreement, redevelopment plan amendment, zoning variances, and historic preservation and public works approvals.
- Redevelopment of a 12-acre big-box retail site in San Mateo, California, with transit-oriented development, including 599 apartments, 60,000 square feet of retail, and two acres of open space, including environmental impact review, 12-year development agreement, specific plan, and design guidelines.
- Reconstruction and reconfiguration of approximately 200-unit affordable housing complex in New Bedford, Massachusetts, including Chapter 40B (Comprehensive Permit) and redevelopment plan amendment.
- Addition to existing facility, and conversion of adjacent building into new adult education center, for non-profit women’s shelter, including land use disposition agreement and zoning variances.
- Consultations with U.S. Army Corps of Engineers and Tribal Representative regarding National Historic Preservation Act, National Environmental Policy Act, and Clean Water Act, for residential subdivision in North Attleboro, Massachusetts.
- Legislative and administrative matters on behalf of the world’s largest outdoor advertising company in regarding its hundreds of sign locations in San Francisco, California.
- Entitlements for San Francisco’s largest new residential project in 60 years, with 1,900 units (360 rent-controlled) and 60,000 square feet of retail.
